Terms of Service

Last updated November 3, 2026

These Terms of Service ("Terms") govern your use of MoldEstimates.com and its tools (the "Site"), operated by ThriveUp LLC, a South Carolina limited liability company ("MoldEstimates," "we," "us," "our"). By using the Site, submitting a form, or requesting an estimate, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

These Terms contain a binding arbitration agreement and a class action waiver in Section 15. They affect your legal rights. Read them.

1. What the Site is

The Site is an informational tool. It gives homeowners a planning estimate for mold inspection, testing, and remediation built from published third-party cost data, and it forwards requests to one featured independent remediation company for an area. We are not a remediation, restoration, inspection, testing, or construction company. We do not perform, supervise, warrant, or inspect any work. We hold no mold, contractor, or inspection license. We are not an insurance agency, a law firm, or a health care provider.

2. Estimates are planning ranges, not quotes

Every cost figure on the Site is a planning range derived from published national data and from the answers you provide. It is not a quote, a bid, an appraisal, an offer, or a guarantee of price, scope, or outcome. Actual cost depends on an on-site inspection by a qualified professional and on conditions no website can see. You agree not to rely on a range as a final price, and you agree that we are not responsible for any difference between a range on the Site and any price you are quoted or charged.

3. No professional advice

Nothing on the Site is medical, health, legal, insurance, engineering, environmental, or financial advice, and nothing creates a professional relationship with us. Content about mold exposure, health effects, state rules, licensing, disclosure, insurance coverage, or building science is general information that may be incomplete, outdated, or inapplicable to your situation. Consult a licensed professional in your state before acting on it.

4. Emergency requests

The emergency request form moves your request ahead of standard inquiries so that a person can call you back sooner. It is not an emergency service, a dispatch service, or a substitute for emergency responders, and we do not guarantee any response time, availability, or outcome. For any situation involving risk to life or safety, a gas smell, an electrical hazard, structural danger, or active flooding that threatens safety, call 911 or your utility first. You are responsible for your own safety and property while waiting for a callback.

5. Independent remediation companies

Featured and referred remediation companies ("Companies") are independent businesses. They are not our employees, agents, partners, joint venturers, or subcontractors, and we do not control their work, pricing, scheduling, licensing, insurance, employees, or conduct. Any inspection, testing, remediation, or other work, and any contract, estimate, invoice, warranty, or dispute about that work, is solely between you and the Company. We are not a party to it. We do not verify a Company's license, insurance, certifications, or claims beyond any checks we describe, and we make no representation that a Company is qualified, licensed, insured, available, or suitable. You are responsible for verifying a Company's license where your state requires one, its insurance, and its scope before hiring it.

6. Your consent to be contacted

When you submit a form, you provide your contact details so that we and the Company for your area can respond. By submitting, you expressly consent to be contacted at the phone number, email address, and other details you provide, by phone call, text message, and email, by ThriveUp LLC and by the Company, about your request and related services. Consent is not a condition of any purchase. Standard message and data rates may apply. You may withdraw consent at any time by replying STOP to a text, by telling the caller, or by emailing [email protected]. You represent that the phone number you provide is yours or that you are authorized to provide it.

7. Your submissions

You are responsible for the accuracy of everything you submit, including property details, contact information, and any links to photos or files. By submitting content or links, you represent that you own or have the right to share them, and you grant us and the Company a non-exclusive license to use them to respond to your request, generate estimates, and improve the Site. Do not submit content that is unlawful, infringing, defamatory, or that contains personal information about someone who has not consented.

8. Acceptable use

  • Use the Site only for your own property or a property you are authorized to act for, and only for lawful purposes.
  • Do not submit false, misleading, or test requests, and do not submit requests on behalf of others without authority.
  • Do not scrape, copy, frame, reverse engineer, or interfere with the Site, its data files, its cost engine, or its forms, and do not attempt to bypass its spam protections.
  • Do not use the Site to send unsolicited commercial messages or to collect information about other users.

We may block, limit, or refuse any use that we believe violates these Terms or harms the Site or others.

9. For remediation companies

Featured-company arrangements, pricing, exclusivity, content production, advertising services, and asset ownership are governed solely by a separate written agreement between ThriveUp LLC and the company. Nothing on the public Site creates a partnership, an agency, an exclusive arrangement, a guarantee of leads, calls, results, or revenue, or any other commitment to any business. Published rates and founding-partner counts are informational and subject to change. Use of the Site by a business does not make it a featured company. Companies that receive requests through the Site must handle homeowner information lawfully and only for the purpose of responding to the request.

10. Intellectual property

The Site, its design, text, data files, cost engine, illustrations, logos, and code are owned by ThriveUp LLC or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. Any other reproduction, distribution, scraping, or creation of derivative works without our written permission is prohibited. Third-party names and sources cited on the Site belong to their owners and are cited for attribution only.

11. Third-party data and links

Cost bands, climate zones, flood ratings, housing statistics, licensing summaries, and similar facts come from third-party sources identified on the Site. We cite them in good faith and check them periodically, but we do not control them, they may change, and we make no warranty about their accuracy or completeness. Links to third-party sites are provided for convenience. We are not responsible for their content or practices.

12. Disclaimer of warranties

THE SITE, ITS ESTIMATES, ITS CONTENT, ITS EMERGENCY FORM, AND ANY REFERRAL ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE AVAILABLE, ERROR-FREE, SECURE, OR UNINTERRUPTED, THAT ANY ESTIMATE WILL MATCH AN ACTUAL PRICE, THAT ANY REQUEST WILL RECEIVE A RESPONSE, OR THAT ANY COMPANY WILL PERFORM.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THRIVEUP LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, OR FOR ANY PROPERTY DAMAGE, PERSONAL INJURY, ILLNESS, OR DEATH, ARISING OUT OF OR RELATED TO THE SITE, ANY ESTIMATE, ANY CONTENT, ANY EMERGENCY REQUEST OR DELAY IN RESPONDING TO IT, ANY REFERRAL, OR ANY WORK PERFORMED OR NOT PERFORMED BY A COMPANY, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICH FOR HOMEOWNERS USING THE SITE IS ZERO. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT THE LAW ALLOWS.

14. Indemnification

You agree to defend, indemnify, and hold harmless ThriveUp LLC and its members, managers, employees, contractors, and agents from any claim, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or related to your use of the Site, your submissions, your violation of these Terms or any law, or your dealings with any Company.

15. Dispute resolution, arbitration, and class action waiver

Informal resolution first. Before starting any formal proceeding, you agree to email a written description of the dispute to [email protected] and to work with us in good faith for thirty (30) days to resolve it.

Binding arbitration. If the dispute is not resolved informally, you and ThriveUp LLC agree that any dispute, claim, or controversy arising out of or relating to the Site, these Terms, any estimate, any referral, or any Company, including the scope or enforceability of this arbitration agreement, will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this agreement. The arbitration will take place in Greenville County, South Carolina, or by video or telephone, and the arbitrator may award any relief a court could award to the individual party. Judgment on the award may be entered in any court of competent jurisdiction.

Class action and jury waiver. YOU AND THRIVEUP LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. Claims may be brought only in an individual capacity, and the arbitrator may not consolidate claims of different parties.

Exceptions and opt-out. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property. You may opt out of this arbitration agreement by emailing [email protected] within thirty (30) days of first using the Site with your name and a clear statement that you opt out. If the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court, not in arbitration, and will be severed.

16. Governing law and venue

These Terms are governed by the laws of the State of South Carolina and applicable federal law, without regard to conflict-of-law rules. Subject to Section 15, any proceeding not subject to arbitration will be brought exclusively in the state or federal courts located in Greenville County, South Carolina, and you consent to their jurisdiction.

17. Termination, changes, and general terms

We may suspend or terminate access to the Site at any time. We may update these Terms; when we do, we change the date at the top, and continued use after an update means you accept the revised Terms. If any provision is held invalid, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the Site. You may not assign your rights under these Terms; we may assign ours. Sections 2 through 5 and 9 through 17 survive termination.
